Pancoast Construction ("Pancoast," "we," "us") is a licensed general contractor (CA License #938999) based at 1319 Carlotta Ave, Berkeley, CA 94703.

This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit www.pancoastconstruction.com (the "Site"), contact us, or request an estimate.

This policy is written to comply with the California Online Privacy Protection Act (CalOPPA), the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the California Invasion of Privacy Act (CIPA), and California's "Shine the Light" law. By using the Site, you acknowledge the practices described here.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

2. Information We Collect

We collect only what we need to respond to you and deliver your project. We do not ask for Social Security numbers, financial account logins, or other sensitive personal information through the Site. Please do not include sensitive details in the contact form.

3. How We Use Your Information

We use personal information only for these business purposes:

Responding to inquiries and preparing estimates and proposals
Planning, permitting, building and warrantying your project
Coordinating with your architect, designer, subcontractors and suppliers
Billing, accounting, insurance and licensing obligations
Operating, securing and improving the Site, and preventing fraud or spam
Complying with law, court orders and Contractors State License Board requirements

We will not use your information for a materially different purpose without first notifying you.

4. Cookies, Analytics and Communications Monitoring

Our Site is hosted on Wix.com, which places essential cookies needed for security, load balancing and basic site function. Geojs.io (which looks up a visitor's location from their IP address), Google Fonts and Sentry (error tracking) are also used by the Site host. We also use Wix Analytics to understand how visitors use the Site, such as which pages are viewed and how visitors arrive.

Third-party tracking. Other than the providers named above, we do not allow third parties to collect information about your online activity across websites over time on our Site.

Notice under the California Invasion of Privacy Act (CIPA). We do not record or monitor the content of your communications with us through the Site except as needed to receive and answer them. When you submit our contact form or email us, the content of your message is processed by our website and email service providers solely to deliver it to us. We do not use pen registers, trap-and-trace tools, session replay, or keystroke-capture technology, and we do not permit vendors to use your communications for their own purposes.

5. How We Disclose Information

We disclose personal information only to:

Service providers that host the Site, deliver email, store files, or handle accounting, under contracts that bar them from using it for any other purpose
Project partners such as subcontractors, suppliers, architects, designers and engineers working on your project
Government agencies such as building departments and permit offices, as your project requires
Professional advisors such as attorneys, accountants and insurers
Legal and safety recipients when required by law, subpoena, or to protect rights and safety

No sale or sharing. We have not sold or shared (for cross-context behavioral advertising) personal information in the past 12 months, and we have no actual knowledge of selling or sharing information of consumers under 16.

Opt-out preference signals. We honor Global Privacy Control (GPC) and similar browser signals as a valid request to opt out of sale or sharing for that browser.

Do Not Track (CalOPPA disclosure). Because there is no common industry standard for Do Not Track, the Site does not respond to DNT signals. We do honor GPC as described above.

6. Data Retention

We keep personal information only as long as reasonably necessary for the purpose it was collected:

7. Your California Privacy Rights

If you are a California resident, you have the following rights under the CCPA/CPRA:

Right to know what personal information we collect, use and disclose, and to get a copy of it in a portable format
Right to delete personal information we collected from you, subject to legal exceptions (for example, records we must keep for licensing or warranty)
Right to correct inaccurate personal information
Right to opt out of the sale or sharing of personal information (we do not sell or share it)
Right to limit use of sensitive personal information (we use it only for permitted purposes)
Right to non-discrimination. We will not deny service, charge different prices, or provide a different quality of service because you exercised these rights

How to submit a request. Email info@pancoastconstruction.com with the subject "Privacy Request," or call 510-280-5221. We will confirm receipt within 10 business days and respond within 45 calendar days. If we need more time (up to 45 more days), we will tell you why.

Verification. To protect you, we will match the information you give us (such as name, email, phone or project address) with our records before acting on a request to know, delete or correct.

Authorized agents. You may use an authorized agent. We may ask for signed written permission and ask you to verify your identity directly, unless the agent holds a power of attorney under Cal. Prob. Code §§ 4000–4465.

Shine the Light (Cal. Civ. Code § 1798.83). We do not disclose personal information to third parties for their own direct marketing. You may ask about this once a year by contacting us as shown below.

Reviewing and changing your information (CalOPPA). You may review or ask us to change the information you submitted through the Site at any time by contacting us.

7. Children, Security and Other Websites

Children. The Site is not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has sent us information, contact us and we will delete it.

Security. We use reasonable administrative, technical and physical safeguards, including encrypted (HTTPS) connections and restricted access to project files. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your information, we will notify you as California law requires.

Links to other websites. The Site may link to sites we do not control, such as review platforms or supplier pages. Their privacy practices are governed by their own policies.

8. Accessibility

We want this policy and our Site to be usable by everyone, including people with disabilities, consistent with the Americans with Disabilities Act (ADA) and California's Unruh Civil Rights Act. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.

This policy is available as text on the Site that works with screen readers and browser zoom. If you need it in another format, such as large print or read aloud by phone, or you have trouble using any part of the Site, call 510-280-5221 or email info@pancoastconstruction.com. We will respond within 10 business days.

9. Changes and Contact

We review this policy at least once every 12 months. When we make changes, we will post the updated policy here and change the "Last updated" date above.
